Terms and conditions

 

In this document we present you the terms governing the use of the ursulaceramica.com website (also called “Site”, “Store” or “We”) by any visitor (“User” or “Customer”) and the general conditions applicable to the purchases made therein. We recommend that you read them carefully.

When using the Site or ordering through it one of the products available for sale, the User agrees to comply with the provisions of these Terms of Use without any reservations. If you have any questions about these rules, you can contact us by email ursulaceramica@gmail.com. If you do not agree with these Terms of Use, you must not use the Site.

Please note that these Terms of Use and the General Conditions of Sale may change without notice. You should therefore consult this page regularly, as the applicable rules are those published when you use the Site or make a purchase there.


TERMS OF USE OF THE SITE


1. PROPERTY OF THE SITE
Ursulaceramica.com is an online store that sells handmade ceramic products, created and managed by Ursula Duarte, contributor nº 236386980 with a professional address in Travessa Santo Ildefonso nº31, 1200-806 Lisboa, which operates in the market with the Ursula Cerâmica brand.

2. USE OF THE SITE
When using the Site, the User undertakes to comply with the applicable laws, refraining from using it for activities contrary to the law, morals and good customs, the rights and interests of third parties.

By registering on the Site, the User declares that all the information he provides is true and corresponds to reality. When registering or placing an order, the User undertakes to:

- make your name, e-mail address, postal address and telephone number available in a true and accurate manner. Without this data, we will not be able to proceed with your order;

- use this Site only to make legally valid inquiries or orders;

- do not place any false or fraudulent orders. If we have evidence that an order of this nature has been placed, we will cancel it and inform the competent authorities;

When placing an order through the Store, the User confirms that he is over 18 and has the legal capacity to enter into contracts.

In the event of misuse of the Site, proven fraud, participation through obtaining an illicit benefit or advantage, breach or failure to comply with any provision provided for in these Terms and Conditions or applicable law, we reserve the right suspend or cancel the User's access to the Site.

The User's access to the Site may be suspended, partially or totally, at all times, especially in management, maintenance, repair, alteration or modernization operations. Creator Ursula Duarte also reserves the right to close the Site, permanently or temporarily, partially or totally, at any time, without prior notice and without any compensation, in any way, to the User.

3. PRIVACY
Access and navigation on the Site does not require the provision of personal data by the User. However, there are features, such as subscribing to the newsletter and registering to purchase products at the Store, that require the User to provide some personal data, such as name, e-mail address or an address for the delivery of the ordered goods. These data will be treated in accordance with the rules defined in the Privacy Policy of the website.

4. INTELLECTUAL PROPERTY
The User acknowledges that the contents of this Site are protected by intellectual property rights, under Portuguese and European Union laws, and undertakes to respect those rights.

All content on the Site, including text, images, sound, animation and other graphic elements, as well as the layout and structure of the Site are the intellectual property of the creator Ursula Duarte, and cannot be used outside the conditions of free use permitted by law without prior written authorization.

Requests for authorization to use the contents of the Site should be sent to the email ursulaceramica@gmail.com.

5. RESPONSIBILITY
We make every effort to ensure that the information presented is free from typographical errors and, whenever they occur, we will proceed as soon as possible to correct them. In the event that the information presented does not correspond to the characteristics of the product, the Customer has the right to return it under the terms defined.

The creator Ursula Duarte will not be responsible for errors in the published content, for irregularities or failures in the functioning of the Site or for any damages that result from the improper use or the inability to use the Site.

The photographs presented on the website are merely illustrative. We recommend that you consult the product characteristics for detailed information.

Despite the efforts of Ursula Cerâmica, some products may have an incorrect price, so we check prices whenever we process orders. If the price of the product is lower than the advertised price, we will refund the difference. If the price is higher, we will inform the Customer by email and await his decision to accept the new proposal or cancel the order.

6. LINKS TO THIRD PARTY PAGES
The Site may provide links to pages of other entities, such as for social networks. These pages do not belong to, nor are controlled by us, so we do not assume any responsibility for the content or the privacy practices of those pages or the pages linked to or referred to. When using the links provided to access external pages, the User must consult the privacy policies of the entities responsible for these sites, as well as the terms of use of those sites.

7. APPLICABLE LAW
These Terms of Use of the Site are subject to Portuguese law. To resolve all issues and disputes that may arise, the jurisdiction of the District of Lisbon is exclusively competent, with express waiver of any other.

GENERAL CONDITIONS OF SALE

The conditions presented here are intended to define the general conditions of sale established between the creator of Ursula Cerâmica, hereinafter referred to as "Shop" or "Us" and the people who wish to make purchases on the website ursulaceramica.com, hereinafter referred to as "Customer" or "User".

These general conditions regulate all the steps necessary to place an order on the ursulaceramica.com website and apply to sales to final consumers, as defined in point c) of article 3 of Decree-Law no. 24/2014 , of February 14.

1. PRICES AND PRODUCTS
The prices listed in the ursulaceramica.com website catalog are in Euros and include VAT at the legal rate in force at the time of purchase, to which are added the costs with the respective applicable postage.

The prices and specifications of the products contained in this website may be changed by Ursula Cerâmica, without any prior notice.

There may occasionally be promotional price campaigns in the form of percentage discounts on the advertised price or promotional prices for sale to the public.

These promotions will always have a defined validity period, indicated on the campaign product page, and will be limited to the existing stock.

To benefit from promotional discounts, the Customer must finalize the order and pay it until the end of the period in which the promotion is in effect. When payment is deferred, the Store guarantees the promotional price up to a maximum period of 48 hours from the date of order confirmation.

2. ORDER REQUEST
The products featured in the online catalog are limited to existing stock. In the event of unavailability of any item, Ursula Cerâmica will inform the Client.

For some products, properly identified, the order may be limited to a certain number of copies.

3. PAYMENT METHODS
Payments are accepted with Paypal. This method allows the Customer to make the payment using his Paypal account, without revealing his bank information. When choosing this option for payment, the Customer is automatically redirected to the PayPal payment portal. This service is provided by the payment management company PayPal (Europe) S.à r.l. & Cie, S.C.A, which does not share with the Store any information about the credit card data used or the Customer's bank account.

4. SHIPPING METHODS AND DELIVERY TIMES
The parts availability period is 2 to 10 working days.

Orders will be sent through CTT (Correios de Portugal) with the following deadlines, after dispatch:

PORTUGAL (Continental and Islands): 2 to 3 working days / minimum 5,90€ until 2kg 

EUROPEAN UNION: up to 7 working days / minimum 10,90€ until 2kg

REST OF THE WORLD: variable, depending on the place of origin of the order dispatched by transporter company.

Purchases made at the Store will not be delivered to PO Boxes, only physical addresses.

Despite the efforts we make to deliver orders on time, there may be delays due to out of stock, unforeseen circumstances and problems in the delivery area. If we are unable to meet the delivery date for reasons beyond our responsibility, we will inform the Customer of this circumstance, giving you the option to keep your order with a new delivery date or to cancel the order with a full refund of the amount paid, without prejudice to all other rights granted to it under the terms of the applicable legislation.

5. SHIPPING VALUES
Shipping rates vary depending on the product's size and weight.

PORTUGAL (Continental and Islands): minimum 5,90€ until 2kg 

EUROPEAN UNION: minimum 10,90€ until 2kg

REST OF THE WORLD: dispatched by transporter company minimum 50€ until 2,5kg


International orders may be subject to the application of customs taxes for which we are not responsible.

6. NON ACCEPTANCE OF ORDER
Ursula Cerâmica reserves the right not to accept the order, informing the Client, in the following cases:

a) Stock break;
b) Unavailability of the article;
c) If Ursula Cerâmica considers that there is misconduct on the part of the buyer or any inconsistency in the registered personal data.


7. EXCHANGES
Within a maximum period of 14 days you can exchange for another piece of equal or greater value.

If you want to exchange a purchase please send an email to ursulaceramica@gmail.com within 14 days of receiving the order and we will also send you all the information and procedures by email.

The parts you want to exchange must be in perfect condition, with no signs of use, and inside the respective box. Since ceramic is a fragile material, the pieces must be repacked carefully. The shipping cost will be borne by the customer.

8. RETURNS
We do not accept returns for custom orders.

If you want to return a purchase please send an email to ursulaceramica@gmail.com within 14 days of receiving the order and we will also send you all the information and procedures by email.

The parts you want to return must be in perfect condition, with no signs of use, and inside the respective box. Since ceramic is a fragile material, the pieces must be repacked carefully. The return cost will be borne by the customer.

After communicating the return, you have 14 days to return the parts. After we receive the returned parts and confirm that they are in perfect condition, a refund of the amount paid for the order will be made including the value of the delivery charges, using the same form of payment used at the time of purchase.

9. GUARANTEES
The Customer must take into account that the ceramic pieces are made by hand, through a handmade process that makes each piece unique and, therefore, the slight irregularities and variations in color, shape and finish cannot be considered as defects.

The warranty does not cover defects that result from normal wear or any other external cause, such as:

- improper use, such as submission to sudden changes in temperature;

- failure to comply with the operating or maintenance instructions on the Site, such as the use of the piece in the stove, oven or microwave or the washing of earthenware pieces in the dishwasher.

To exercise this right, the Customer must report the product's lack of conformity to the Store within two months from the date it was detected, by email ursulaceramica@gmail.com or letter sent to the store's headquarters. This communication must include a description of the problem and be accompanied by a copy of the purchase invoice.

The Client may choose one of the following solutions: replacement, appropriate price reduction or termination of the contract, whichever is more reasonable, within the limits imposed by good faith, good customs or the social or economic purpose of that right. As ceramic products, we consider that repair is not a possible solution.

If the Customer chooses to replace the damaged product, we undertake to replace the part with another, similar or equivalent, within a maximum period of 60 days.

10. CIVIL RESPONSIBILITY
The Store is not responsible for any damages, direct or indirect, of the Customer or third parties, which result from the use of the products sold.

11. CUSTOMER SUPPORT
If the Customer has any questions or complaints, he can contact the Store through the email address ursulaceramica@gmail.com.

12. APPLICABLE LAW AND JURISDICTION
Contracts signed under these General Sales Conditions are governed and must be interpreted in accordance with Portuguese law.

In the event of a consumer dispute, the consumer Customer can use the European Online Dispute Resolution Platform, available at http://ec.europa.eu/consumers/odr or the following alternative consumer dispute resolution entities:
